These Terms of Service ("Terms") are entered into between Nanjing Nengjiang Information Technology Co., Ltd. ("we", "us", or "our"), a company registered in China with a registered address at Room 62075, 1st Floor, East Commercial Area, Olympic Sports Center Stadium, No. 222 Middle Jiangdong Road, Jianye District, Nanjing City, Jiangsu Province, China, and you ("User" or "you"). These Terms govern your access to and use of the SkyQuiz website (www.skyquiz.net, the "Website") and all related services (the "Services"), including but not limited to creating, sharing, and participating in fun tests (psychological tests, personality tests, horoscope tests, game personality tests, etc.).
1. Service Overview
1.1 We provide a platform for Users to create, publish, share, and participate in various fun tests. Users may access the Services through the Website, which is developed with UniApp, Vue, and Node.js, and hosted on secure servers provided by Tencent Cloud (Tencent Cloud Computing (Singapore) Private Limited) in Singapore.
1.2 We reserve the right to modify, update, suspend, or discontinue any part of the Services at any time, with or without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.
1.3 To use certain features of the Services (e.g., creating and saving tests), you may need to register an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to maintain the accuracy of such information.
2. User Account Responsibilities
2.1 You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately at xunandmi@gmail.com if you suspect any unauthorized access to or use of your account.
2.2 You shall not share your account credentials with any third party, and we shall not be liable for any loss or damage arising from your failure to protect your account.
2.3 You may delete your account at any time through the Website's account settings. Upon account deletion, we will process your data in accordance with our Privacy Policy, including storing account information for 6 months to prevent malicious registration and fraud, before anonymizing or deleting it.
3. User Obligations and Prohibited Conduct
3.1 When using the Services, you agree to comply with all applicable laws, regulations, and these Terms, and to refrain from engaging in any of the following prohibited conduct:
- Creating, publishing, or sharing tests that contain illegal, offensive, defamatory, discriminatory, pornographic, violent, or harmful content, or content that infringes upon the intellectual property rights, privacy, or other legal rights of third parties;
- Using the Services to engage in fraud, spam, phishing, or other illegal activities that harm us, other Users, or third parties;
- Interfering with or disrupting the operation of the Website or Services, including but not limited to hacking, introducing malware, or overloading server resources;
- Unauthorized access to, copying, or modifying any data or content on the Website or Services;
- Using the Services to collect personal information of other Users without their explicit consent;
- Violating any applicable data protection laws, including the Personal Data Protection Act (PDPA) of Singapore, GDPR (for EEA users), and CCPA/CPRA (for California users).
- 3.2 We reserve the right to review and remove any content that violates these Terms or applicable laws, and to suspend or terminate your account without prior notice if you engage in prohibited conduct.
4. Intellectual Property Rights
4.1 All intellectual property rights in the Website, Services, and related content (including but not limited to logos, text, graphics, code, and algorithms) are owned by or licensed to us. You shall not reproduce, distribute, modify, or create derivative works of any such content without our prior written consent.
4.2 You retain ownership of the intellectual property rights in the tests (questions, options, scoring rules) and content you create and publish on the Website ("User-Generated Content"). By publishing User-Generated Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the purpose of providing and promoting the Services. This license shall terminate upon deletion of the User-Generated Content or your account.
4.3 You warrant that your User-Generated Content does not infringe upon the intellectual property rights or other legal rights of any third party, and you shall indemnify us against any claims, losses, or damages arising from a breach of this warranty.
5. Third-Party Services and SDKs
5.1 The Services may integrate third-party SDKs (e.g., Google Analytics 4, Facebook Share SDK, Stripe Payment SDK, UniApp Core SDK) and link to third-party websites or services. These third-party services are governed by their own terms of service and privacy policies, and we shall not be liable for any loss or damage arising from your use of such third-party services.

6. Disclaimers of Warranty
6.1 THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 We do not warrant that the Website or Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We shall not be liable for any loss or damage arising from the unavailability, delay, or interruption of the Services, including due to server maintenance, technical failures, or third-party service disruptions.
6.3 Test results provided through the Services are for entertainment purposes only and do not constitute professional advice (psychological, medical, or otherwise). You shall not rely on such results for any decision-making or personal guidance.
7. Limitation of Liability
7.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE WEBSITE OR SERVICES.
7.2 OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT OF USD 100.
7.3 This limitation of liability shall not apply to (a) gross negligence or willful misconduct by us; (b) liability for personal injury or death; (c) fraud; or (d) any other liability that cannot be excluded by applicable law.
8. Termination of Services
8.1 We may suspend or terminate your access to the Services at any time, with or without prior notice, if you violate these Terms, applicable laws, or if we determine that your use of the Services poses a risk to us, other Users, or third parties.
8.2 Upon termination, your right to use the Services shall immediately cease. We may delete or retain your account data and User-Generated Content in accordance with our Privacy Policy and applicable laws.
9. Applicable Law and Dispute Resolution
9.1 These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China and the Personal Data Protection Act (PDPA) of Singapore (given that user data is stored in Singapore). For users in the EEA, UK, California (USA), and other regions with specific laws, these Terms shall also comply with applicable local regulations.
9.2 Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiation between you and us. If negotiation fails, the dispute shall be submitted to the people's court of the jurisdiction where our registered address is located (Jianye District, Nanjing City, China) for resolution.
10. General Provisions
10.1 We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of these Terms and notify you through a prominent notice on the Website (e.g., pop-up window) or via email (if you have provided one).
